Please read these Terms of Service carefully before using the Recipe Scanner app or any other product or service offered by PAI Labs LLC ("PAI Labs," "we," "us," or "our"). By downloading, accessing, or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
These Terms of Service constitute a legally binding agreement between you and PAI Labs LLC. Your continued use of any PAI Labs product constitutes acceptance of any updates to these Terms. We will notify you of material changes via in-app notice or email.
Recipe Scanner is an iOS application that enables users to digitise, organise, and manage recipes by scanning printed materials, importing from URLs, and importing from third-party platforms including websites, YouTube, and Instagram. Additional products and services may be offered by PAI Labs from time to time.
You must be at least 13 years of age to use our services. By using the app you represent that you meet this requirement and have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access at peter@PaiLabs.co.
Important notice regarding third-party content. Recipe Scanner allows you to scan physical recipes and import recipe content from third-party websites, YouTube videos, and Instagram posts. You acknowledge and agree to the following:
(a) User Responsibility. It is your sole and ultimate responsibility to ensure that you only use the content import and scanning features of the app in a manner that complies with the terms of service, robots.txt directives, scraping policies, and intellectual property rights of the content creator or platform from which content is imported.
(b) Best Efforts by PAI Labs. PAI Labs uses commercially reasonable best efforts to respect publicly stated content creator scraping and access policies, including robots.txt directives where technically practicable. However, PAI Labs does not warrant or guarantee that all content accessed through the app complies with every third-party platform policy, as those policies change frequently and without notice.
(c) Personal, Non-Commercial Use. The content import feature is intended solely for importing recipes for your personal, non-commercial use. You agree not to use the app to scrape, aggregate, redistribute, resell, or republish content at scale or in any manner that violates applicable law or third-party rights.
(d) PAI Labs Not Liable. PAI Labs expressly disclaims all liability arising from your use of the content import or scanning features in a manner that violates third-party terms of service, intellectual property laws, or any applicable regulation. Any claims, damages, or legal proceedings arising from such misuse are solely your responsibility.
All technology, trademarks, logos, and content produced by PAI Labs are the exclusive property of PAI Labs LLC. Recipes and content you import remain the property of their respective owners. You retain ownership of any personal notes, collections, or original content you create within the app.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PAI LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAI LABS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF PAI LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO PAI LABS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless PAI Labs LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys fees) arising out of or relating to your violation of these Terms or your use of the services, including but not limited to any misuse of the content import or web scraping features.
We may suspend or terminate your access to the services at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at peter@PaiLabs.co. Sections 5, 7, 8, 9, and 11 survive any termination.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in San Diego County, California.
We reserve the right to update these Terms at any time. We will provide notice of material changes. Your continued use of the services after the effective date of any change constitutes your acceptance of the updated Terms.
